Forward Facing Dog, LLC, located in California, USA ("we," "us," or "our") operates the Drillsy Fitness website (drillsyfitness.com) and Drillsy applications, products, and services (Doing Business as “Drillsy”, “DrillsyFitness”, “DrillsyApp”, “DrillsyStudio”). This Privacy Policy is meant to help you understand how we collect, use and share information to operate, improve, develop and help protect our services, or as otherwise outlined in the Policy. This includes how we collect and process your personal information such as when you visit our websites, use any Drillsy products or services including Drillsy applications (the "Apps"), or when you interact with us via our support service including live chats and e-mail communications, social media channels, experiences and recommendations supported by artificial intelligence (“AI”), (together, the "Services'').
This Privacy Policy explains how we collect, use, disclose, share, and protect your information when you use our Apps and Services. We are committed to protecting your privacy and handling your data responsibly. By using the Apps and Services, you agree to the practices described in this policy. If you do not agree, please do not use our Apps or Services.
Who We Are
Drillsy is a fitness app that allows users to do workouts, create custom workouts, create moves, save moves, save workouts, like content, share content, comment on content,, add music playlists to content, and subscribe to fitness creator channels. Drillsy uses technology and design to empower users to make fitness, a part of daily life.
Please be sure to read this entire Privacy Policy before using or submitting information through our Apps and Services. By using or submitting information through our Apps and Services, you are acknowledging the collection, transfer, manipulation, processing, storage, disclosure and other uses of your personal information/data as described in this Privacy Policy.
1. Information We Collect
Depending on how you interact with us, we may collect your personal information. The sources from which we collect this personal information fall into three categories: Information you provide directly, Information we collect automatically, Information we collect from other sources. See below for more information on the types of personal information in each category.We collect the following types of information:
1.1 Information You Provide Directly:
When you interact with us you may volunteer personal information, or you may be asked to provide personal information in order for us to provide the services and use of our Apps and Services. Examples of interacting with us: accessing our Services, downloading our Apps, choosing to receive marketing communications, completing and/or using one of our registration forms, reviewing our content, contacting us with inquiries, responding to one of our surveys; and purchasing or using our services.
Standard Identifying Information. Name, mailing address (including zip/post code), billing address (including zip/post code), email, date of birth and phone number. These may be collected when you register for Apps and Services, subscribe to Drillsy marketing, or communicate with us. Please note, if you provide a name in your Profile, it will be Public and Members can search for you by name, unless you have toggled on “Make Profile Private” in Preferences.
Purchase Information. Details related to Services you order and provide when you purchase any Services. Please note, we do not directly store or capture any credit card information. This information is collected directly by our payment processing partners, but we would like to inform you about its collection since this information is collected through our site and from you, our customer.
Profile Information. Information that you provide in connection with your Drillsy Profile, such as username, and any additional information you choose to provide to enhance your use of the Apps and Services, including your weight, height, gender, general location, photo, picture, tags, image, avatar and the Standard Identifying Information listed above. Please note the information you provide in the name section of your profile, username, tags, location (if you add it) and profile image (if you add one) will always be Public.
Voice. We may use a person’s voice to activate the Apps and Services and follow workout commands where Voice Control is available. If a person opts in, voice data may be used to improve our abilities to understand voice commands in general. This data is not used for identification purposes nor is it stored by us.
Workout Characteristics. Information you provide in order to track your performance and chart your progress while using our Apps Services, e.g. gender, height, weight, heart rate (if a provided by a Paired Application or a compatible heart rate monitor is connected), workout repetitions, exercises, weights and equipment used.
User Generated Content. Any content or material you publish or post such as drills, workouts, posts, messages, images, audio, hashtags/tags, photos or videos on our Apps and Services for example.
Paired Applications: Third Party Apps and Accounts that you link to your Drillsy account and Other Applications. We enable you to connect your Drillsy account with third parties (i.e. devices, apps, APIs, or websites that integrate with our Apps and Services). Where you choose to connect another company's device or account to your Drillsy account, or engage in Services that feature a partnership with a third party, we may, with your consent, collect information from your use of the connected device(s) to facilitate interaction with our Services. Activity trackers are an example of a connected device, and music streaming is an example of a connected account. Information collected by these third parties is subject to their terms and policies and governed by your privacy choices recorded with these third parties.
Feedback and Support Communications. Any details of your communications/interactions with us, including when you call, email, live chatbot, video call or text with our support teams or communicate with us via social media channels or community forums. We may record, on our own and/or with the assistance of a Service Provider, support calls for training, analytics and monitoring purposes and to help resolve issues. We will tell you before recording and, where required by applicable laws, obtain your consent for the collection of these recordings. Our live chat Service Provider records information you submit in the chatbot, as well as any dialogue with member support, and may also use chat data to improve chat services for us. We collect, retain, and use Feedback and Support Communications based upon our business need to receive and act upon your feedback or issues, and for training purposes.
Quizzes, Testing, Surveys and Review Information. Any information you voluntarily provide to us or our Service Providers (or otherwise publish) in connection with setting fitness goals, testing a new Service, survey you complete or review / testimonial you provide about Drillsy Apps and Services. We may collect this information to understand your opinions, better market our services, collect relevant information about our business, and develop new Services.
Sensitive Personal Information. We process Sensitive Personal Information for the purposes of providing Services, carrying out our legal obligations or exercising specific rights as permitted by law. The definition of Sensitive Personal Information depends on jurisdiction and where you are located, but health information, biometric data, precise geolocation data, information relating to race, sexuality, and religion are examples of what may be considered sensitive in some locations. By choosing to use our Services, you acknowledge that you will not disclose Sensitive Personal Information to us through, or in connection, with our Services unless we have explicitly requested such disclosure from you.
Other Information. Any other information that you may provide to us in connection with your use of our Services and / or other contact that you have with Drillsy.
1.2 Information that we collect automatically
We, and our third-party partners, automatically collect information you provide to us and information about how you access and use our products, Apps and Services, when you engage with us. We typically collect this information through the use of a variety of our own and our third-party partners' automatic data collection technologies, including (i) cookies or small data files that are stored on an individual's computer and (ii) other, related technologies, such as web beacons, pixels, embedded scripts, mobile SDKs, location-identifying technologies and logging technologies. Information we collect automatically about you may be combined with other personal information we collect directly from you or receive from other sources.
We, and our third-party partners, use automatic data collection technologies to automatically collect the following data when you use our services or otherwise engage with us:
Information About Your Device and Network, including the device type, manufacturer, and model, operating system, IP address, browser type, Internet service provider, and unique identifiers associated with you, your device, or your network (including, for example, a persistent device identifier or advertising ID). We employ third-party technologies designed to allow us to recognize when two or more devices are likely being used by the same individual and may leverage these technologies (where permitted) to link information collected from different devices. We collect this in order to improve the Apps functionality, overall performance, user experience, security, and user analytics.
Information About the Way Individuals Use Our Apps and Services and Interact With Us, including how frequently you access our services, whether you open emails or click the links contained in emails, whether you access our services from multiple devices, and other browsing behavior and actions you take on our services (such as the pages and screens you visit, the content you view, videos you watch, the communications you have through our Apps and Services, and the content, links and ads you interact with). We employ third-party technologies designed to allow us to collect detailed information about browsing behavior and actions that you take on our services, which may record your mouse movements, scrolling, clicks, and keystroke activity on our services and other browsing, search or purchasing behavior. These third-party technologies may also record information you enter when you interact with our products or services, or engage in chat features or other communication platforms we provide. We collect this in order to improve functionality, overall performance, user experience, and market analysis.
Information About Your Location, including general geographic location that we or our third-party providers may derive from your IP address.
All of the information collected automatically through these tools allows us to improve your customer experience. For example, we may use this information to enhance and personalize your user experience, to monitor and improve our products, Apps and Services, such as: (1) remember information so that you will not have to re-enter it during your visit or the next time you visit the site; (2) provide custom, personalized content and information, including targeted content and advertising; (3) identify you across multiple devices; (4) provide and monitor the effectiveness of our Apps and services; (5) monitor aggregate metrics such as total number of visitors, traffic, usage, and demographic patterns on our Apps and Services; (6) diagnose or fix technology problems; and (7) otherwise to plan for and enhance our products and services.

1.3 Information we collect from other sources
Other Applications. If you access our Services through a third party application, such as the Apple App Store or Google Play App Store (together with any similar applications, "App Stores"), we may collect information about you from that third-party application that you have made public via your privacy settings of the Other Application(s). This may include: your name, your user ID, your App Store user name, location, sex, birth date, email, profile picture and your contacts on the Other Application(s). We may receive your information from third-party products services with which you opt in to integrated features, such as Apple Health. If you choose to leverage these third-party integrations, we may receive information that you have opted in to share through such integration.
Single Sign-On: We may provide you the ability to log in to our products, Apps, and Services through certain third-party accounts you maintain. When you use these single sign-on protocols to access our Apps and Services, we do not receive your login credentials for the relevant third-party service. Instead, we receive tokens from the single sign-on protocol to help identify you in our system (such as by your username) and confirm you successfully authenticated through the single sign-on protocol. This information allows us to more easily provide you access to our products, Apps, and Services.
Mobile Sign-On: We may provide you the ability to log in to our mobile applications or authenticate yourself using facial, fingerprint, or other biometric recognition technology available through your mobile device. If you choose to utilize these login features, information about your facial geometry, your fingerprint, or other biometric information will be collected by your mobile device for authentication purposes. We do not store or have access to this biometric information. Instead, your mobile device will perform the biometric authentication process and only let us know whether the authentication was successful. If the authentication was successful, you will be able to access the applicable mobile application or feature without separately providing your credentials. Security and Safety Partners. We may collect certain information from third parties in order to protect and verify your information, provide our Services, and ensure your safety and the security of your account. This may include: device IP, general location, and other identifiers.
Other Sources. We may receive information about you from other sources to supplement information provided by you. The supplemental information allows us to enhance our ability to provide Services, provide information about our Apps and Services, and send marketing communications you have chosen to receive. This may include: information about how you interact with our Services, such as through activity trackers, third party information to supplement our research and marketing efforts.
Advertisers, Influencers, and Content Creators: We engage in advertising both on our services and through third-party services. Advertisers, influencers, and publishers may share personal data with us in connection with our advertising efforts. To Our Affiliates: To provide our Apps and products and facilitate our Services, Drillsy entities disclose personal data to other Drillsy entities for purposes and uses that are consistent with this Privacy Notice.
To Your Employer: If you interact with our services in connection with your employment, we may disclose personal data to your employer or another company for which you work. For example, we may provide information to your employer about your usage of our services in connection with your work for them.
To Other Customers and the General Public: We make available personal data designed for sharing through our services with certain or all other Drillsy customers, or the general public, based on the applicable privacy settings and intended recipients. Keep in mind that the customers who view customer-generated content can always reshare or redistribute the content both on and off our services or save or copy the content outside of our services. In addition, by publicly posting content on our services, you are directing us to disclose that information as broadly as possible and directing those accessing the content to do the same.
To Marketing Providers: We coordinate and share personal data with our marketing providers in order to advertise and communicate with you about the products and services we make available.
To Ad Networks and Advertising Partners: We work with third-party ad networks and advertising partners to deliver advertising and personalized content on our Apps and Services, and across other devices. These parties may collect information automatically from your browser or device when you visit our websites and other Services through the use of cookies and related technologies. This information is used to provide and inform targeted advertising, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research
To Integrated Apps: When you opt in to share information with third-party products or services via integrated features, such as Apple Health, we may share personal data with these services, or we may allow these services to collect personal data directly from you in connection with our services. These third parties may use your personal data for their own business and commercial purposes, including to provide their products and services to you.
To Service Providers: We engage other third parties to perform certain services on our behalf in connection with the uses of personal data described in the sections above. 4. Fitness Data
"Fitness Data" means any information relating to your fitness performance and/or workouts, including things like, length of workout, reps, duration, and heart rate if you consent to connecting a heart monitor. We do not use or process your Fitness Data for identification purposes.
Why do we process your information?
Analyze your performance, As part of our offering, we use Fitness Data to compare your past and current performance and to provide you with analytics about your progress over time.
Provide you with insights and recommendations.We will not disclose, redisclose, or otherwise disseminate Fitness Data unless:
Authorized by you or your authorized representative; if you connect your Drillsy account to a Paired Application you are authorizing Drillsy to use the data from the Paired Application the same way we use Drillsy data;
Required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction; or As required under applicable law, necessary for the establishment, exercise or defense of legal claims of wherever courts are acting in their judicial capacity.
5. Your Privacy Rights and Choices
The following privacy choices are made available to all individuals with whom we interact.
Direct Marketing, Advertising, and Digital Media: You can stop receiving promotional email communications from us by clicking on the "unsubscribe" link provided in any of our email communications. Please note you cannot opt-out of service-related email communications (such as, account verification, transaction confirmation, or service update emails). You can also contact us by using the details provided in the Contact Us section. We will process your request within a reasonable time after receipt, in accordance with applicable laws.
Push Notification Preferences: You can stop receiving push notifications from us by changing your preferences in your device's notification settings menu or in the applicable service-specific application. Please note we do not have any control over your device's notifications settings and are not responsible if they do not function as intended.
Direct Marketing, Advertising & Digital Media
We may send marketing communications for purposes disclosed to you (including the reasons described above in WHY WE USE PERSONAL INFORMATION) and, where required by applicable law, with your consent. You can unsubscribe from direct marketing at any time by following the instructions below or by contacting us using the details provided in the HOW TO CONTACT US section. 5.1 Withdrawing Your Consent
If we collect and process your personal information with your consent then you can withdraw your consent at any time in the Preferences section under your Profile or by contacting us using the details provided under CONTACT US section below. Please note, such withdrawal will not affect the lawfulness of the processing prior to your withdrawal.
5.2 "Do Not Track" / Global Privacy Control Do Not Track ("DNT") is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Please note that, because there has been no agreed industry standard, we do not respond to or honor DNT signals or similar “do not track” mechanisms transmitted by web browsers.
Please note you may opt out, and we honor, certain technologies broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC). 6. Data Retention
We retain the personal information we receive as described in this Privacy Policy for as long as you use our Apps and Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements and comply with applicable laws. Legal requirements, however, may require us to retain some or all of the personal information we hold for a period of time that is longer than that for which we might otherwise hold it. Drillsy Apps and Services are not directed to, or intended for, children. We do not knowingly collect personal information directly from children who do not meet the minimum age requirement applicable in your jurisdiction, and if you do not meet the age requirements as specified in our Terms of Service.
If we become aware that we have collected personal data from a child under the minimum age, we promptly delete the personal data.

We may update our Privacy Policy from time to time. When we do, we will take appropriate measures to inform you, consistent with the significance of the changes we make.
